set exch 2010 server as the default hub transport

We are in the process of moving our organization to exchange 2010. we were running on 2007 and have a 2010 server running with a handful of mailboxes migrated to the 2010. The issue i'm having is every few hours the "hub version 14 queue" holds the emails destined for the 2010 server. We hope to use the html signatures pulled form AD through the 2010 transport rule but can't afford for people to be out of email for an hour at a time 3 times or so a day. so...

Can I make all outgoing mail route through 2010 server? how? is there a simple option to make one of the two servers the primary?

I have an internal and even tried a second making one for each server specifically. and still every couple hours the messages queue up and i just have to wait till it stops losing its mind and they just go, can anyone give me ideas of where to look for answers? I can ping both servers from each other and telnet between the two. If I set up the internet connector with just the 2010 server as source the mail queues waiting for the 2010 as well (I guess).

edit - i forgot this is the error on the queue in retry: 451 4.4.0 Primary target IP address responded with: "421 4.2.1 Unable to connect." Attempted failover to alternate host, but that did not succeed. Either there are no alternate hosts, or delivery failed to all alternate hosts.
 
Have you tried disabling tcp autotuning?

netsh interface tcp set global autotuninglevel=disabled
 
More information on autotuning is at It takes much longer than expected to download an e-mail message from a POP3 server in Outlook 2007 or in Outlook 2010 - there are some links at the end of the article that explain more about autotuning. I'm not sure that it is autotuning as the symptoms aren't quite right - it usually prevents connecting at all, not 'now you can, now you can't'. Run the command on the Exchange 2010 server - if the 2007 server is using an os that supports it, run it there too. (vista level and up, which would be windows 2008 on the server side?)

(Ignore the fact that the kb is about pop3 - the links at the end are useful)
 
no dice on the auto tuning the queue is still backing up.
